Fotohaus Brings Copyright Complaint Against ITM

On November 2, Fotohaus, LLC. (“Fotohaus”) filed a Complaint against The University of Chicago’s Institute for Translational Medicine (“ITM”) for copyright infringement. According to the Complaint, owner and photographer of Fotohaus, Daniel Foster, created the photo “Medical Research 2” in 2015, and assigned the copyright to Fotohaus.

In May of 2021, Fotohaus became aware of ITM using the photo on two separate published sections of its website without obtaining permission. One is the Radiomics section, the other is on the image navigation of the ITM website. The Complaint also states that both the original photographer and Fotohaus do license their works for commercial use on a selective basis. Fotohaus also alleges that they informed ITM of the infringement in May of 2021, but the parties were unable to resolve the issue. The Plaintiff believes that this work was used to promote and advertise ITM and their research, and Fotohaus is seeking actual damages.
