A Nurse Training Program Alleges Infringement against New Competitor
On November 4, 2020, Health Education Center, LLC (“HEC”) filed a lawsuit against A Servant Heart Training Institution, LLC ("Servant Heart”). Both companies provide training and certify nursing assistants in the state of Kentucky. Defendant Servant Heart entered this specific market in May 2020.

In its complaint, HEC asserts that Servant Heart “[used] and [published] a significant portion of copyrighted material from the website of Plaintiff.” According to HEC, before the lawsuit was filed, on July 21, 2020, it sent a cease and desist letter to Servant Heart. HEC claims that it has not received a response to this letter and that Servant Heart “continues to knowingly and willfully use, publish and distribute a significant portion of the Copyright.”
