General Limitations
Section 108(a) allows the reproduction of “no more than one copy of a work” subject to certain restrictions:
- The reproduction must be made without attempting to gain a commercial advantage.
- The library must be “(i) open to the public, or (ii) available not only to researchers affiliated with the library or archives or with the institution of which it is a part, but also to other persons doing research in a specialized field; and”
- The reproduction must include a notice of copyright, appearing on the copyright, or on a legend stating that the work may be copyrighted.
