Section 108 of the Copyright Act allows libraries and archives, within limits, to make and distribute copies of all types of copyrighted works for replacement purposes.
If the work is published, the library or archive may make up to three copies of the work as long as the copies are solely for replacement of an item that is damaged, deteriorating, lost, stolen, or in an obsolete format and the institution has determined, after a reasonable effort, that an unused copy of the work cannot be obtained at a reasonable price. A format is considered obsolete if the machine or device necessary to perceive a work in that format is no longer manufactured or is no longer reasonably available in the commercial marketplace. If the copy is in digital format, it may not leave the institution’s physical premises.
